What causes a NICS denial?
A deny message from the NICS indicates the subject of a background check has been matched with a similar name and/or similar descriptive information of a record containing a state law prohibition or any of the following federally prohibitive criteria.
Typically, the process can take anywhere from 2 to 12 months.
The Fair Credit Reporting Act (FCRA) provides you with the following rights: Potential employers must notify you if a background check is the reason you didn't receive a job offer. You must receive a copy of your background check if you request one.
When it comes to background checks, “no news is good news.” Unfortunately, chances are that from time to time you will be alerted to something that has shown up in one of your employee's background checks.
Most background checks can be completed between three days to one week. FBI checks usually take around 30 days. Although some instant background checks are available, these rely on databases that can be incomplete or inaccurate. Instant criminal records databases, in particular, often contain many errors.
What Are Turnaround Times for Criminal Background Checks? A criminal background check generally takes between one to three business days, but can be returned much faster depending on the database that is being search, such as the National Criminal Database.

Two to five business days is how long it generally takes for the potential employer to get the results back–so don't expect a reply right away. It may take one to two weeks to hear back after a background check is done.
A background check for Walmart typically takes five days but can take up to 30 days. Walmart conducts background checks on potential new hires to limit the risk to the company, its employees, and its customers.

DOJ also has the authority to temporarily delay a firearm transaction, for up to 30 days from the date of the initial transaction, when unable to determine the purchaser's eligibility to own or possess firearms within the typical 10-day waiting period.
If you believe you have been erroneously denied or have received an extended delay on a firearms transfer, you may request an appeal of your deny or delay decision.
Waiting period laws give law enforcement additional time to perform an accurate background check and create a “cooling off” period to prevent acts of violence or suicide attempts. If sold from a federally licensed dealer, a gun can be transferred to a purchaser before a proper background check is performed.
This allows the DOJ to process the request for the FBI name check and forward it to the FBI within the required 90 days. After 90 days, the FBI deletes the fingerprint background check transactions and considers the FBI background check request complete.
California, Rhode Island, and the District of Columbia impose a statutory waiting period on all firearm purchases. Subject to limited exceptions, California and the District of Columbia require a ten-day waiting period for all firearm purchases.
A “Delayed” message means the FBI needs to do additional research to verify the person's background. Our staff works closely with federal, state, local, and tribal law enforcement agencies and courts to verify eligibility.
A delay response indicates that information you supplied on the ATF Form 4473 has been matched with information contained in the National Crime Information Center, the Interstate Identification Index, and/or the NICS Indices.
Generally, all firearms purchases and transfers, including private party transactions and sales at gun shows, must be made through a California licensed dealer under the Dealer's Record of Sale (DROS) process. California law imposes a 10-day waiting period before a firearm can be released to a purchaser or transferee.
At the federal level, less than one hundred NICS denial cases are prosecuted a year. This is because ATF declines to prosecute these cases. Point of Contact states which run their own NICS checks also prosecute very few cases.
